J1 changing to F1

Hello,

 

I have a query about my residency status for the 2020 tax return. It is a complicated history. 

I entered the united states on 12/27/2018 during my J-1 Visa grace period. My J-1 intern visa started in early Jan-2019. I went back to my home country by the end of June-2019. Got my J-1 intern visa renewed and came back to the US in mid-august 2019. And I leaving the country now at end of nov-2020. And I am going to get an F-1 visa starting Jan-2021. So, Will, I be a resident or non-resident alien for the upcoming tax year?

For year 2021, you will be considered as a nonresident.  

 

As a F- visa holder, you have total 5 years being exempt lifetime ( not counting days hence nonresident status) including both J and F visa.  Therefore, you would be counting your exempt years start from 2018 until 2022.  You will be considered as a nonresident from 2018 until 2022 ( J visa 2018-2020, F visa 2021-2022). 

 

As TurboTax does not support nonresident status, you are suggested use Sprintax to complete your filing of Form 1040-NR.
