Can someone explain to me how am I getting the Lifetime Learning Credit when I’m not eligible for it? I’m eligible for the Earned Income Credit though.

I’m not paying for the deluxe if I don’t qualify for the LLC.

Can you clarify why you believe you are not eligible for the Lifetime Learning Credit? The qualifications are:

  • You, your dependent, or a third party paid qualified education expenses for higher education
  • The qualified education expenses were for an eligible student
  • The eligible student is you, your spouse, or a dependent on your tax return
  • For the full credit, your 2021 MAGI (modified adjusted gross income) is less than $80,000 ($160,000 if you are filing jointly)
    • For a reduced credit, your MAGI is between $80,000 and $90,000 ($160,000 and $180,000 if you're filing jointly)

Well I was told that by TurboTax that I wasn’t getting the AOC or LLC because I don’t qualify for it. It says I have the EIC but when I get ready to file I can’t because I supposedly have the LLC and have to pay deluxe to file it. I’m not doing that if I don’t qualify for the LLC.

Try this:

Go through the entire education interview until you reach a screen titled "Your Education Expenses Summary".  Click delete next to the student's name.
