In order to deduct patent attorney fees and filing fees do I have to form a business in the business section of Turbo Tax? Thank you.

Yes, if you are filing a 1040 Individual Tax Return in TurboTax you will have to create a business identity in order to enter the income and expenses related to Self-Employed Income. The Income & Expenses will subsequently be filed with your return using Schedule C. TurboTax will ask you questions regarding your business and appropriately place this information in Schedule C.
