Will i get in trouble if i add up payments made to college without having 1098-T, but will amend taxes once judge orders ex wife to give me the form?

ex wife is refusing to give me the 1098-t form and i get to claim our son in college for 2017.  he won't provide me with the info either, and i really don't want to wait last minute to file my taxes.  i was going to put in the figures i have now, and then later on when i finally have the form, amend and correct the amount.  i'm sure it's a lot more than what's on one bill, that doesn't incl. cost of books, supplies, etc..

When you file your tax return, you are signing that the information provided is accurate and true.  I recommend waiting until you have Form 1098-T, which is REQUIRED when you are claiming education credits.

Once you have a copy of Form 1098-T, you can always amend your return at a later date to receive the education credit.
