used wrong form 1040 instead of 1040NR

Hi,

I didn't know that I was supposed to use Sprintax and submit 1040 NR, and rather used Turbotax and sent 1040 for the tax year 2020 and got 1800$ refunded by direct deposit through Turbotax. (Turbotax took $253 for the processing fee so what I got was $1500 ish) I think it was because they accidentally determined me as a resident alien and gave me the educational tax credit from tuition.

I searched that I'll have to do this;

 - Form 1040X

 - Form 1040NR or 1040NR-EZ with “AS AMENDED” written on top of each page, and

 - a copy of the Form 1040 you originally submitted with “COPY OF ORIGINALLY SUBMITTED” on top of each page.

My question is, do I have to include the check with the forms that I'm sending to the IRS? But since Turbotax got the service fee of $253, should I send it back through Turbotax? Or do I send an $1800 check to IRS and forget about the service fee since it's only for the processing fee?

Thank you.

No, you would not send it back through TurboTax.

Yes, you should include a check for whatever amount is owed.

As for how to proceed with the 1040NR and 1040X, you would be best to get that information from Sprintax as you may not need to pay the full amount back.  You may not owe your entire refund back, but you will not know until you take care of the amendment with the correct information.

Hi,

Thank you so much for the reply.

So you mean I'll have to

write a 1040X through Sprintax and see what the amount is, right?

Thanks again for the help. Really appreciated.

Yes, you will need to do everything through Sprintax. However, I would suggest you talk to a live person there instead of just online forms as you may need to do additional steps to properly go from one form to the other form.  .
