If I claim someone as a dependent on my 2021 taxes, will they have to pay back their 2021 $1,400 EIP? They were were not a dependent in 2020 and filed their own taxes.

Hello, I was wanting to find out if I were to claim my adult child as a dependent on my 2021 tax returns this year, will they have to pay back their 2021 $1,400 economic stimulus payment they received? They filed their own taxes in 2020 and were not claimed as a dependent, which is the return the EIP was based on last year. I am confused and need clarification. I cannot seem to find a written answer anywhere. Thank you for any clarification.

No, they will not have to pay it back.  They were eligible to receive the payment based on their 2020 tax return.

When I enter them as a dependent into TurboTax it then wants to give me 1,400 for the stimulus when I enter I just got 1400.  Should I say I got 2800 to avoid that?  I would not think I can get 1400 for claing my adult child for 2021 when they were already paid the 1400 stulus in early 2021?

You are eligible to receive the Recovery Rebate Credit of $1,400 on your 2021 tax return, even if the dependent already received the 3rd stimulus payment based on their 2020 or 2019 tax return.  The dependent does not have to pay back the payment.
