I Recieved My Incarcerated Spouses Stimulus Checks

Since I have been married, I have always filed my taxes Married filed jointly even after my spouse was sentenced to 20 years. I have received the last 2 stimulus checks via direct deposit and they both included the funds for me and him as well. Will I have to return the money to the IRS since he is incarcerated?

there is no such indication on a tax return.

In any case, once the stimulus payment is in your hands, IRS is not permitted to ask for it back.

Thanks, Fanfare. I asked because someone from a nonprofit (TIFA I believe) called and said they were going to prosecute me if I did not send him the money. I never asked the IRS to send me anything. If I am supposed to repay the IRS I am more than happy to do so. I have never been in trouble with the law before!
