I filed my taxes without my 1095a form. will I get my refund then amend it or do I need to amend it first.

Wait until you get your refund to file the amendment you have until April 18, 2016 to get this done. You should not try to amend your return until it has been fully processed and you have received your refund or your payment has cleared.

Amended returns do not “catch up” to your original return and replace them; they are processed as two separate returns.

I filed mine before I got the 1095a on January 26 and it was accepted by the IRS on that day, but last week, all of my orange bars disappeared and I got a letter in the mail yesterday from the IRS saying they needed a completed 8962 form, a copy of my 1095a and a newly computed page 2 of my tax return showing the transferred amount from form 8962 (you use the information from your 1095a to fill out form 8962), so if they catch that you didn't do the 1095a form, you won't get your refund, you will get that letter. Hope this helps

In order to complete the 8962 you will need to start as an amending return but that return will not be filed as per IRS instructions.
You will only send in the 8962

According to the letter I got from the IRS, I had to send in the 8962, a copy of my 1095a and a newly computed page 2

i received my state today. its been 21 days and still no letter or federal return.

I got my letter on the 21st or 22nd day, faxed it in on the following day, which was February 17, was able to order return transcript February 26 & today, February 27th, woke up & my bars are back, approved & direct deposit date of March 2nd. So, a total of 2 weeks from when I faxed in the 1095a, 8962 & newly computed page 2 of W2

actually you dont need to file an amended form in order to get corrected copies of the 8962...turbo tax keeps saying you do but you do not.....go sign into your turbo tax account then go to add a state....it will bring you to your original return click on federal at the top and then on health correct your issue then print it out your 8926 will be there along with page 2 and if you havent got your 1095a yet call the market place company and they will give you all the info you need to fill out 1095a and if you need a 1095 a form you cant fill one out for free that is blank and then print it o and no need to mail anything faxing is much faster o and if you call the irs they will give you a batch number to add on your cover letter when you fax it

@Sarahsmith916  You would only be able to amend your return or make the correction, if the IRS rejects the return. If the return was already filed, you will need to wait until it has been processed and you have received your refund or confirmation that any tax due was paid. (If you file an amended return while your first return is being processed, it can cause extended delays for both returns)

If the IRS would reject your return for any reason, then you would be able to go in and make any necessary changes to your tax return and resubmit.

Amended returns can only be mailed. It is suggested that it be mailed certified with return receipt (or other tracking service) to verify that the IRS receives it.

You can check the status of the amended return here, but allow 3 weeks after mailing.
