I came here under u4u and been here for 55 days.I got a job, was previously unemployed in Europe.I don't understand my tax residency and deductions. Can you help with it?

Hi! I came to USA on 1 June under Uniting 4 Ukraine program and paroled here for 2 years. I am here already for 55 days. Previously I was unemployed for all year and didn't have any income. I also don't have any assets like vehicles or property. I am single.  I've got a job here! And my employer asked to file a 4w form, where I need to write down my deductions. As far as I understand, they are based in my tax residence, but I can't understand anything. I have tried to resolve everything by myself for 3 days straight, read all info on IRC website, read articles, watched YouTube, unfortunately I don't understand anything.  Can you help me identifying my tex residency and my deductions, please? Thank you very much in advance!

Hi lada_di, 

You will be considered a United States resident for tax purposes if you meet the substantial presence test for the calendar year 2023. You must be physically present in the United States on at least:

1. 31 days during 2023, and 

2,. 183 days during the 3-year period including 2021, 2022 and 2023.

From 6/1/2023 - 12/31/2023 there are 213 days, so you should meet the substantial presence test for a US resident for tax purpose for tax year 2023 and file income tax return(s) in early part of 2024. You have no income before you came to the US.

 

Based on your description, you would fill out W-4 Step 1 - name and address, social security number and mark the "Single" box, and sign and date Step 5 for your employer.
