I am a non-resident alien and I applied for my tax refund through Turbotax and I learned that this is illegal. Is there any way I can cancel this process? My tax refund has already been approved.
Yes and no. You can't really cancel your return, however, you can complete an 1040X amended return and attach the 1040X to your 1040NR which Turbotax does not support, but our partner Sprintax.com does. If you want to do this electronically, Sprintax.com can help with this.
When you complete the amended return which is the 1040X, you will only fill out your name, address, ITIN which is on the front page and then skip to part 3 which is the reason why you are filing an amended return. Your reason would be that you are a NRA and filed the wrong return and need to file a 1040NR instead. Do not complete
"Resident and nonresident aliens. Use Form 1040-X to amend Form 1040-NR. Also use Form 1040-X if you should have filed Form 1040 instead of Form 1040-NR, or vice versa.
