How to file additional filing requirement forms 8804;8805;8813?

After filling form 1065, I received a IRS notification asking for additional filing requirement forms 8804;8805;8813 due the partnership has foreign partners. I prepared the forms manually, the question is how to file?  can I send only those forms separately via mail to IRS or should I amend my e-file in turbotaxes by attaching the missing forms?

Per the Instructions for Forms 8804, 8805, and 8813 at this link, you send those forms separately via mail to this address:

Internal Revenue Service Center
P.O. Box 409101
Ogden, UT 84409

According to the 8805, one of them (COPY C - Tax Attach to your federal tax return) should be submitted with Federal income, but if I do an electronic filing with TurboTax I cannot.

I also understand that Copy A is for the For Internal Revenue Service and should be attached to the Attach to Form 8804, which I can mail.

My concern is the one copy that should be attached to the federal tax return.    I am afraid that if I file one electronically without the Copy C of the 8805, it will delay processing the 1065 as it would determine it incomplete.   Any advise?

Thanks

Hello,

Did you send the form separately by mail to the IRS, and did it work?

Thank you and greetings, Christian.

I searched and couldn't get helpful info about TT Business and 8804,8805and 8813.

I got letter from IRS as well about 8804 for 2023 Tax withholding for Foreign Partner. I didn't withhold since it's first year as partnership (use to be a sole LLC), and thought 1040ES for new foreign partner would work. Ok, I need to pay, say, extra $5k withholding for 2023 beside 1040ES money. Then how to reflect this amount money in (foreign partner) member's individual tax return? I guess foreign partner also need to resubmit his tax return?

Thx

Foreign partners must attach Form 8805 to their U.S. income tax returns to claim a credit for their share of the tax withheld by the partnership. If they have already filed for the current tax year, they would need to file an amended return to claim the withholding.

TurboTax does not support Forms 8804, 8805, or 8813 in any version.

See this IRS link for more information and form instructions: About Form 8804
