How long after my ex husband files an amendment, allowing me to claim my son, can I file?

How long do I need to wait to file my return after my ex husband amended his form allowing me to claim my child? He amended his return last night and I don't want to send mine in before the IRS recognizes the mistake.

As your ex-husband's amended return had to be mailed in and hand-processed by the IRS, it may take up to six weeks.

The best solution for you is to print your return and file it by mail now. By the time the IRS processes your return, your ex-husband's amended return would have been processed and everything will be OK.

If his original tax return has already been filed and accepted by the IRS claiming the child, then you cannot e-file your tax return.  You can only print and mail your tax return claiming the child on your return, it cannot be e-filed since the IRS already has the SS number of the child on an Accepted tax return.  Amending a tax return does not change the IRS database for Accepted tax returns.  Since an amendment has been filed you can file your tax return at any time.

Agreed ... your ONLY choice is to print, ink sign and mail in the return ... you will never be able to efile it no matter when the other party's amended return is processed.
