How do I amend something from 2012?

I got a letter recently stating that I owe money to the IRS for not reporting casino winnings in 2012

Is the IRS asking you to amend your 2012 return or have they calculated what they say you owe and are asking you to pay that amount? 

 

TurboTax no longer supports the tax program for 2012. You could download the form 1040X and complete it yourself or you would have to find a tax program or a tax preparer with the 2012 tax program on their computer to prepare the amended return for you.

When I filed my 2012 Return, it was e-filed. I have the original disk for 2012 and it works but when I click on amend this return it tells me that I have to wait because the e-file hasn't been received by the IRS yet. How do I get around this?

@bjcaudill Is your question a typo?   Are you really asking about a

2012

tax return?   Why are you trying to amend a 2012 return?   What are you trying to do?   You have only three years from the filing deadline to amend a tax return to receive a refund --- you are not going to get an additional refund for a 2012 tax return.

Generally, the IRS can only audit you for 3 years after the date you filed, but sometimes they have 6 years.  When did you actually file your 2012 return?  (If that is not a typo).

 

Turbotax is not supported that far back, the program probably won't run on a more recent operating system and Turbotax does not support the updates that would be needed to the CD version, which was released before the forms were final (that's why updated are needed.)

 

You may want to seek professional advice as to whether you owe anything, based on the statute of limitations.  If you decide you do owe, you can just pay the assessed tax and the IRS will adjust your file.  Or, if you have losses to report, that might reduce the tax you owe, but you would need to see a professional or do your amended return by hand.

do you really mean 2021 because it is extremely strange that the IRS would take 9 years to issue a bill? 

do you really need to amend? the IRS sent you a bill for not reporting gambling winnings.  the only reason to amend is 1) the IRS wants an amended return or 2) you have more gambling losses to report and you can itemize your deductions. gambling losses which are a schedule A deduction can not exceed gambling winnings.

You may not be able to at this point. See the Taxpayer Advocate Service (TAS) information below.

 

Unfortunately there is a statue of limitations and the time has run out for 2012.  The date for 2012, was April 15, 2016.

  • One exception is you can amend the later of the statute date or two years after the tax is paid whichever is later.  For this reason you could try, but it's unlikely the IRS will accept.

You can amend the following tax returns right now:

  • 2019: Final Date April 18, 2023
  • 2020: Final Date April 15, 2024
  • 2021: Final Date April 15, 2025

Any return earlier than those listed can be amended but there will be no refund issued if applicable. 

 

The best resource for you may be the Taxpayer Advocate Service (TAS).  They are in place to assist in situations where you are unable to obtain resolution on your own.

  2. Submit a request for assistance - Form 911 Request for TAS Assistance (instructions are included)
  3. Locate the local TAS Office for your area

This will get the process started for you.  It's not going to be a fast process because they are handling a large volume at this time. 

 

If you do not hear from TAS within one week of submitting Form 911, contact the Taxpayer Advocate office where you originally submitted your request. Incomplete information or requests submitted to a Taxpayer Advocate office outside of your geographical location may result in delays.
