Filed 2023 taxes as a non-resident alien (pending I-485 in 2023). Got a green card in May 2024. How to amend 2023 taxes for a refund? Can TurboTax be used?

I filed my 2023 taxes using Sprintax as a non-resident alien due to my pending I-485 status. In May 2024, I received my green card. I’d like to amend my 2023 return to reflect this change and file for a refund. Can I use TurboTax for this process, and what steps should I follow?

You will need to file a 1040-X, and you can use TurboTax to create the 1040.  See How do I file a 2023, 2022, or 2021 tax return?

 

After you complete your 1040, you will need to complete Form 1040-X to amend-  it is easiest to paper file this following these steps:

 

  1. Enter your name, current address, and social security number (SSN) or individual taxpayer identification number (ITIN) on the front of Form 1040-X.
  2. Don’t enter any other information on page 1. Also don’t complete Part I on page 2 of Form 1040-X.
  3. Enter in Part II—Explanation of Changes the reason you are filing Form 1040-X.
  4. Complete a new or corrected return (Form 1040, 1040-SR, 1040-NR, etc.).
  5. Across the top of the new or corrected return, write “Amended.”
  6. Attach the new or corrected return to the back of Form 1040-X.

Thank you for your response! I have a few follow-up questions to clarify my situation before proceeding:

  1. Based on my description (filed my 2023 taxes as a non-resident alien using Sprintax, but I was on a pending I-485 Adjustment of Status throughout 2023, received my EAD in August 2023, and my green card in May 2024), am I eligible to use TurboTax to amend my return and change my filing status to the resident alien for 2023?

  2. If yes, does TurboTax provide additional support for amendments that I can pay for, such as step-by-step assistance or a review of my amended return?

  3. Given my situation, would you recommend proceeding with TurboTax, or should I consult a tax professional due to the complexity of my case?

No, because you were not a resident in 2023. You may not file as a US resident until 2024 because this is the year you received your green card. There is no need to prepare an amendment.

 

You may use Turbo Tax to prepare your 2024 return and rather you file or not depends on the complexity of the return.
