Hi, I'm from France and I moved to Los Angeles almost 7 month ago, therefore, that's the first time I have to fill a tax return here. My husband is still in France for his work 'til the end of May. In order to fill my taxes return, I need to ask for a ITIN for him. I filled the W-7 on his behalf, but my question is: Do I send it with my federal tax return, with my state tax return or with both?

You will send the W7 with the federal tax return only. For the state, write in "applied for" in the social security space and you can send them the ITIN once it is assigned.

Could you please elaborate more on that? Do you mean I can send it in the next year's tax filing while I do e-file, if not could you please tell us when and how to send it to State tax office? TIA!
