Do I send a 1040x '21 return now that the dependent identity theft has been solved? The IRS also removed an additional dependent when they recalculated that year.

5 dependents that year. The IRS recalculated my return because a dependent was already used in the system. They removed that dependent due to the identity theft, but they also removed an additional dependent for no reason. She was an infant born that tax year. Her identity was not used by someone else, they cleared that last week. All 5 dependents were listed correctly on the 1040. I responded to their recalculation letter within the timeframe allowed, but have not heard back and have not received the adjusted refund to account for them removing her. In order to correct the error they made and receive the refund due for both dependents, do I need to file 1040x?

Since you are already working with the IRS to resolve this issue, I highly recommend that you do not file a 1040-X as that may confuse the situation.

 

If you do not hear back from the IRS in a timely manner, you may want to try contacting the Taxpayer Advocate to help you get things straightened out.

Keep in mind, since this is a 2021 tax return, you want to make sure it is worked out by 4/15/25, or 10/15/25 if you filed a timely extension so that you are able to claim the refund.  See IRS: Time you can claim a credit or refund
