I let my child’s father/bf carry our 6 month old as a dependent out of good will and he temporarily lives with me. His refund has been approved but has a notice of an offset due to back child support for his other children. Is it possible to amend mine/his return so that I can claim our child instead and get the money rather than it being offset and given to his other child’s mother, eventually due to the child support situation. Our daughter lives with me permanently wouldn’t that make me the custodial parent since he’s using this address only temporarily?

So to be clear about this, I would specifically have to amend MY return and add her as my dependent instead even tho he claimed her on his offset return, and still successfully get the refund amount back for just her?
