Audit for eic

  • I got audited for EIC due to filing status Head of Household and I was married. We have no legal separation papers. They want proof my wife was out of our home. Will we both need to provide proof of residency?

To qualify to file as Head of Household, you must be considered Unmarried, i.e.  your spouse did not live in your home during the last six months of the tax year.

 

Both spouses have to prove that they lived at different addresses at least during the last 6 months of the tax year.
