What is e-file reject F1040-164-01?

E-file reject F1040-164-01 means that Form 8862 (Information to Claim Certain Refundable Credits After Disallowance) is missing from your tax return.

You’ll need to complete Form 8862 if your Earned Income Credit (EIC) was disallowed for any year after 1996, and permission was later restored (you'll get another notice from the IRS). Once you complete the form, you’ll be able to claim the EIC.

You can create the form in TurboTax. Select your version for instructions.

  1. Sign in to TurboTax and select Fix my return.
  2. Go to earned income credit.
  3. Continue through the Earned Income Credit section until you reach Do any of these uncommon situations apply?
  4. Select I got a letter/notice from the IRS telling me to fill out an 8862 form to claim the Earned Income Credit, then select Continue.
  5. Continue until you reach the screen, Since you got an IRS notice, we need to check on a few things. Do any of the following apply? Select No, none of these apply and I need to fill out the 8862 form, then Continue (You may need to maximize your browser window).
  6. Answer the questions about the Earned Income Credit.
  7. When you come back to the Your tax breaks screen, select Review.
  8. Go through the Review section to find and correct any blank entries on the 8862. Once corrected, run through the review again until there aren't any errors.

Once the review is complete without errors, you're ready to refile:

  1. Select File.
  2. On the Welcome back screen, select Continue (not Fix my return—you've already done that).
  3. Follow the instructions to save and refile your return.
  1. Open your return in TurboTax and confirm the status of your return(s).
  2. Search for earned income credit and select the Jump to link.
    • Another option is to go to the Deductions & Credits section in TurboTax to find the EIC section.
  3. Continue through the Earned Income Credit section until you reach Do any of these uncommon situations apply? Select I got a letter/notice from the IRS telling me to fill out an 8862 form to claim the Earned Income Credit, then select Continue.
  4. Continue until you reach the screen Since you got an IRS notice, we need to check on a few things. Do any of the following apply? Select No, none of these apply and I need to fill out the 8862 form, then select Continue.
  5. Answer the questions about the Earned Income Credit.
    • Select the Forms mode for easier entry.
    • Select Form 8862, then answer the questions about Earned Income Credit.
  6. Select Continue or use the Error check to find and correct any blank entries on the 8862.
  7. Fix any errors, then select Error check again.
  8. Submit your return if there are no more errors.
  9. Select File and follow the onscreen instructions.
  10. Go through the Review section to find and correct any blank entries on the 8862. Once corrected, run through the review again until there aren't any errors.
