Spouse

Can I claim my spouse as a dependent if they are self employed and earn less than the amount that is required to report to IRS?

Usually you would file together as Married Filing Jointly or you would each file separately as Married Filing Separately or as Head of Household if there are children claimed.  Even if your spouse has an ITIN instead of a SSN, you can still file together.  

 

Your post says your spouse works.  So even a Dependent Care credit would not apply, that is only for a disabled spouse.  Is there some reason you believe they are your dependent?
