Please help

Hi,

I have been in America since June last year and got married to my husband in October. I'm here on a Visa Waiver and am currently going through the process with lawyers in relation to change of status etc but my husband has been supporting me since I arrived here last year and would love to be able to claim me.

Does anybody know where I stand with all of this? I believe that as long as I would be able to attain an ITIN number that he could but I would prefer not to incur him additional charges and we just are unsure about what to do here.

Any advice is greatly appreciated! Thank you!

Since you were married on Dec 31, you  may be able to make the election to file a joint return. Please see  Nonresident Alien Spouse | Internal Revenue Service and Resident Aliens | Internal Revenue Service for information on filing and claiming.
