For Form 2555, for line 14

For Form 2555, for line 14. Date arrived in USA is 12/10/2022, and Date left USA is 1/30/2023. Qualifying under bona fida resident test. But my tax preparer is saying for the date left he must enter a 2022 value, so he put 12/31/2022. Is there a way to enter a 2023 value for date left or N/A or Continues???

I want to report this correctly (tax return may be used for immigration)

In the TurboTax online and desktop versions, the “date left the U.S.” (for Form 2555, line 14) can be in 2022 or 2023 (but you can’t put “Continues,” like you can for the Bona Fide Residence end date). This could be different with other software, or your preparer may for some reason have a personal preference about using December 31st (since the context is time spent in the U.S. during the tax year).

 

The IRS doesn’t give any guidance about line 14 (which isn’t included in the 2555 calculation, and is relevant only if your Bona Fide residence might be in question) in the Form 2555 instructions, or in Publication 54. So I think it’s a bit of a gray area if we’re only concerned about an accurate tax return.

 

However, @superduper, you have some non-tax reasons for using the 2023 date, so I recommend bringing it up again with the preparer. (If it’s one of our full service experts, I predict that conversation will go smoothly...)
