I filed myTax return wrong as a resident but I figure out later that I am not, I arrived on 07/12/2019 in the US with the Visa L1. So can I submit as a first year choice? If I do that, am I considered eligible to receive the stimulus check? I do not want to take a risk to receive something that I am not eligible for and create an issue in my VISA status.
Thank you all in advance
It depends.
Can you clarify what you mean as the first year choice? What first year choice are you trying to make?
In regards to the stimulus payment, please see the attached link for more details on eligibility for the payment. You would need to have a Social Security number be eligible for the payment.
If you determine you are eligible, you can use the following link to register for the stimulus payment.
Hi Jotika,
I am talking about this information https://www.irs.gov/individuals/international-taxpayers/dual-status-aliens
If I am considered in this dual-status I am wrong to receive the stimulus check or I am eligible?
It depends.
If you met the requirements to receive a stimulus payment as mentioned above, and if you had a Social Security number, you would be eligible to receive the stimulus payment.
The problem is they only mention residents and nonresidents. I do not find anywhere information about dual-status. So a person that is considered as a dual-status and applies for the First-Year Choice and has SSN, are eligible or not? It is not clear.
