"Can" be claimed but "Will not" be claimed

I qualify as a dependent child but my parents and I would prefer not to claim me so I can benefit from Education Credit 1098-T and Premium Tax Credit 1095-A. 

 

We already filed our taxes and they want to remove me as a dependent so I can use this. Will that be fine?

This advice is for your parents:

 

If your son/daughter is under 19 (or under 24 and a full time student) and he does not provide more than half of his own support for the tax year, you can claim him as a dependent. 

 

You do have the choice of not claiming him. If you do not claim him, then you lose the Other dependent credit of $500 and you cannot claim his education credit from his form 1098-T.

 

As for your son, on his own tax return, he is asked the question whether he paid more than half of his living expenses with earned income. If the answer is No, then he must say that he can be claimed as a dependent by someone else. 

 

If someone can claim him as a dependent but does not actually claim him, he can claim the non-refundable part of the American Opportunity credit, but not the refundable part. If he doesn't have any tax liability, then there is no tax benefit for him.

I am 22 years old my AGI is 24k, I lived with them but supports myself even if I lived in their house.  I received 1098-T as a full time and 1095-A for Advance Premium Tax Credit. We both agreed they could claim me as a  dependent and they owe $451.

 

After we both filed, we realized that I would get way more refund if I checked I CAN BE CLAIMED but also checked WILL NOT BE CLAIMED as dependent plus they will only owe $100 more because of the rules on 1095-A. 

 

 

Can we both amend now? Should we do it by mail or can we both do it through e filing? Thanks a lot.

You can amend. You will have to wait until your returns are accepted by the IRS.

 

You can use this IRS tool Where's My Refund? to check on the status of your refund. It provides updates regarding the processing of your tax return. This is the best way to track the status of your refund.

 

If you are amending your 2024 tax return and you filed your original 2024 tax return in TurboTax you will be able to e-file your amended return. ‌ There are some circumstances where you will be unable to e-file your amended 2024 return and you will have to mail it in. TurboTax will tell you if it has to be mailed.

 

Some things to keep in mind:

 

  • You must wait until your original return has been accepted to amend it.
  • Wait until you get your refund or have paid your taxes. Have a copy of your original return at your side before you start. And be sure you use the correct year’s software of TurboTax.
  • You must file a separate Form 1040-X for each tax return you are amending.
  • Amended returns can take more than three months for the IRS to process.
  • Gather your original tax return and any new documents needed to prepare your amended return.
  • Print a copy of your return that you are amending and have it ready to refer to. 
  • Use the same TurboTax account you used to file your original return. 
  • Be sure to only make changes to the areas of your return that need amending
  •
