anyone else get this code error TY25_NY_IT398

Error TY25_NY_IT398 is a New York state tax error code.

 

The filing status or taxpayer information does not match the 

  • NY Department of Taxation and Finance records, or 
  • A required form is missing

To fix this, 

  • Verify personal information (SSN, name), ensure the correct Tax Year (TY25) is used, and 
  • update form IT-398 if necessary

I'm getting the same error, and my NY state return has been rejected 3 times because of this. TurboTax Desktop says the form will be updated on or after 1/31/2026. Well, it's time where is it? It's extremely annoying that the program lets you file when there is an outdated form. Do better Turbo Tax! 

 

Error: TY25_NY_IT398 - Your New York state return requires a product update before it can be electronically filed.

Please try again after 01/31/26. Sometimes the updates are not deployed until later in the scheduled day.

I did the software update this morning and submitted. No warnings. I'll report back after it has been accepted/rejected.

I called customer service again. Very nice and professional rep. I was told to update the state form and try again later. I tried a sixth time after re-generating the state formsand submitted again, and it got rejected. Could be something on the New York State end or TurboTax. I'll give it a day or two, and then I will escalate.

I submitted my New York State return eight times using the Desktop Home & Business version, and it was rejected each time—without any warnings from the software.

Today, I resolved the issue by downloading the latest New York State update (using Check for Updates). I then reopened the state return and selected the option to go through the state forms again (not the “go through all forms” option), which forced a recalculation. After doing this, I resubmitted the return and it was accepted.
