NYS form NYC-1127

The program calculates this form because I was an employee of NYC but a nonresident. However, I worked for CUNY, and I am exempt from this tax. How do I prevent Turbotax from including this form in my return?

Additional issue: I am retired, but the program seems to have counted my pension income or something as employee wages.

Form NYC-1127 is not included in your state tax return. It will not be filed unless you print it and mail it. If you e-file your New York tax return, Form NYC-1127 will not be included. If you file by mail, just don't include the NYC-1127.


For TurboTax to have created Form NYC-1127 you must have entered something, perhaps accidentally, that indicated that you might have to file it. Is any NYC-1127 information on your W-2? When the state interview asked your New York City residency status, did you select nonresident? In any case, TurboTax won't create the form unless you go through the NYC Employment Taxes topic. You could skip that topic altogether. If you do go to that topic, the first question is "Do you need to complete Form NYC-1127?" If you answer No the form will not be created. You can remove Form NYC-1127 from your return by going back to the NYC Employment Taxes topic and answering No to the question about whether you need to complete it.

If your pension was reported as wages on Form 1040 line 1a, you must have entered it incorrectly. You got a Form 1099-R for your pension income. Did you mistakenly enter the 1099-R as a W-2? If so, delete the W-2 that you entered, and enter the 1099-R as a 1099-R.
