Form 1099

I have quite a few questions , I'm a independent contractor for a carpet company, I filled out the W9 form. They will be giving me a 1099 . However, my spouse works for me . Attorney suggested I have a joint/partnership business because I'm not allowed to give my spouse a form if we file joint taxes. How can I go about that ?

Not sure about that.  I think you can give your spouse a 1099Misc or W2.   Then you include their W2 or 1099Misc in the Joint return.  If you give her a 1099Misc she has to fill out her own schedule C.   Better check with an accountant not an attorney.
