When you file a 2020 tax return you *might* be able to say you could not be claimed as someone else's dependent. But have you been supporting yourself and your child in 2020? You say you are a student. If you are a full-time student under the age of 24, your parents may still be able to claim you as a dependent for 2020; they may also be able to claim the baby as a dependent on their tax return. We have no details--so we do not know.
If your situation changed for 2020 and you supported yourself and were not a full-time student, then you will be able to say on your return that no one could claim you. If that is the case, you should be able to get the stimulus payment for yourself and for your child. The stimulus payments people got in 2020 were really an advance of a credit that will be available on a 2020 return that is filed in 2021, so you have another chance to get it next year
WHO CAN I CLAIM AS A DEPENDENT?
You can claim a child, relative, friend, fiance (etc.) as a dependent on your 2019 taxes as long as they meet the following requirements:
Qualifying child
• They are related to you.
• They cannot be claimed as a dependent by someone else.
• They are a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
• They are not filing a joint return with their spouse.
• They are under the age of 19 (or 24 for full-time students).
- No age limit for permanently and totally disabled children
• They live with you for more than half the year (exceptions apply).
Qualifying relative
• They don't have to be related to you (despite the name).
• They cannot be claimed as a dependent by someone else.
• They are a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
• They are not filing a joint return with their spouse.
• They lived with you the entire year.
• They made less than $4200 (not counting Social Security)
• You provided more than half of their financial support. More info
