If you are legally married and living with your spouse at any time during the last six months of the year then you can only file your tax return as either Married Filing Jointly or Married Filing Separately.  In most all cases it is more beneficial to file as MFJ then MFS.

If you are married and have not lived with your spouse at any time during the last six months of the year then you may be eligible to file as Head of Household if you have a qualifying child as a dependent and you have provided over one-half the cost to maintain your home among the other requirements.
