State tax filing
Because your spouse is a part-year resident, Virginia law says that if you file jointly, you must both use Form 760PY (the Part-Year Resident form).
Ensure the dates are correct for residency:
- Go to the Personal Info section.
- Review your spouse’s residency. Ensure they are marked as Part-Year with their specific dates.
- Review your residency. Ensure you are marked as a Full-Year Resident of Virginia. Your residency dates will be Jan 1 – Dec 31.
- When you get to the Virginia state interview, the software will ask: "Which form do you want to use?" or "Do you want to file a joint part-year return?"
- Select the option to file Jointly on Form 760PY. This will allow you to stay on one return while still identifying you as a resident for the whole year.
