Yes. Include an explanation with your New York return as to why you are claiming $0 wages. A letter from your employer would be helpful stating that New York tax was withheld by mistake.

 

NY may still challenge your position, claiming you are a NY-based employee working in Florida for your own convenience, so specify that you did not work in NY a single day and that you have minimal connection to NY.

 

You do not have to send a copy of your federal return.
