Did the IRS seize your 2022 joint refund for back tax owed by your spouse?

 

 

No, you cannot amend a 2022 tax return to remove your spouse's name.   If you filed a joint return with your spouse for 2022, you are not permitted to change to filing married filing separately after the mid-April filing deadline.

 

I am not even sure if this would work for you now, but the thing you could have done for 2022 if your spouse owed back taxes, is to file as an injured spouse so that the part of the refund that could be attributed to your earnings would be protected.  It is extra tricky to file injured spouse if you are in a community property state.  You could try amending to file 2022 as an injured spouse.

Do not expect quick results from amending. It can take four months or more for the IRS to process an amended return.
