You said "his" taxes. Did he prepare a joint return and include all of your information on that return? When you file a joint return, all of the combined income and combined information from both spouses is on the same Form 1040, and the refund comes with both names on it.
Or did he file "married filing separately?" If you file married filing separately, each spouse must file their own return and follow some strict rules, which can be complicated if you are in a community property state.
When you are legally married, you have two choices: married filing jointly or married filing separately. You need to know what he did. If he filed married filing separately, then you still need to file your own tax return.
