Amend your 2022 return. As Tax Champ bluedeb says, “You need to file your 1099 in the year it’s for.”

 

Not reporting a Form 1099-S will likely get you an IRS tax notice. Sometimes someone will sell a home for no profit either because they were eligible for the home sale exclusion or they sold their home at a loss.

 

They don’t report the sale on their tax return. However, if the IRS gets a 1099-S, IRS will assume the entire sale was profit, unless you amend your return and tell them otherwise.
