He cannot be claimed as your dependent if he did not live with you for half the year. The custodial parent who had him for more than 183 nights of 2020 can claim him. IF---IF you and the other parent have a signed Form 8332 then the custodial parent can claim him for EIC and Head of Household filing status, and you can claim him for the child tax credit. But only if there is a signed agreement.
