If the state requires the Form 3853 even though you have no penalty then you will have to include the form with your state tax return.

The California Form 3853 has not yet been finalized by the state for filing with the 2020 state tax return.  It is schedule to be available on 02/11/2021.  Until it is available you cannot e-file the state return.

Additionally, state tax return cannot be e-filed until after the federal tax return has been e-filed and accepted by the IRS.

The IRS will not be accepting a 2020 federal tax return until February 12, 2021.
