if he CAN be claimed on your taxes, then whether or not you claim him is immaterial. He is not eligible.
if he is eligible to be your dependent, you have the option to claim him or not - the IRS doesn't care.
but he doesn't have that option. if he CAN be claimed, he isn't eligible for the stimulus. there is a question on his tax return that asks CAN he be claimed by others? the question is not WAS HE claimed by others.

if you may be claimed as a dependent on another taxpayer’s return you are not eligible for the stimulus
it doesn't say if you weren't claimed
