In your top question you said you work with them. Who is "them"? More than just your partner? They might have a partnership and need to be filing a partnership return or multi member LLC. You can still be a 1099Misc independent contractor for it. If you are married on Dec 31 you can file a Joint return. Nothing you said affects that.
