The IRS does not do anything to compensate you for being the victim of identity theft, if that is what you are asking.   If someone filed a fraudulent tax return using your information you can file your own correct tax return and let the IRS sort out whether you should receive a refund or if you owe.  Or you can pursue legal action yourself against the person who committed the theft.

  • Respond immediately to any IRS notice; call the number provided.
  • Complete IRS Form 14039, Identity Theft Affidavit. Then print and mail or fax according to the instructions. 
  • Continue to pay your taxes and file your tax return, even if you must do so by paper.
