If you have been filing tax returns as "married" in a common law state, then you have used the common law marriage rules to your advantage.   You are subject to all of the rules---which means if you have not obtained a divorce, your filing choices are still to file as married filing jointly or married filing separately now.   Or.....if you have lived apart from your spouse for at least the last six months of 2024 and have custody of the children, you might be able to file as Head of Household.
