Your marital status is determined as of the end of 2023. If your divorce was final before the end of 2023, then you do not file as married. You file as Single. Nothing about your spouse's income goes on your 2023 return, nothing about your income goes on his 2023 return. He files as Single too. Or....if one of you has the children and you lived apart for at least the last six months of 2023, that parent can file as Head of Household. You are done with "community property" for 2023.
