If you are not actually working for the business then you really do not need to be on the payroll and being paid rent would make more sense.  Of course that would be reported on the Sch E and not be considered earned income thus things like retirement contributions would not be allowed and it could affect the tax return in other ways.  

 

I am surprised an income tax attorney would not be more help so I suggest you seek a CPA or EA  who knows corporate returns since you really need to take both the personal & business tax returns into consideration before you make a decision.
