I won an EAJA settlement against the FAA. This award was to cover legal fees incured by me fighting the FAA. The FAA sent me a 1099 for this settlement. Is this taxable?
The legal proceedings took 4 years. In that time the legal fees were not deducted. The fees were directly related to protecting my job. Had I lost I would have been unable to work.
I paid my attorney hourly and directly. The EAJA settlement check was sent to me directly.
If this is considered income can I somehow deduct it?
I view this settlement from the FAA as a reimbursement.
