Who qualifies?
Individuals age 55 or older who received qualifying military benefits are eligible for the subtraction. Taxpayers and surviving spouses are eligible for the Military Benefits Subtraction if they turn 55 at any time during the taxable year for which the subtraction is taken.
What military benefits qualify?
"Military benefits" are defined as:
- any military retirement income received for service in the Armed Forces of the United States
- qualified military benefits received pursuant to Section 134 of the Internal Revenue Code regarding certain military benefits
- benefits paid to the surviving spouse of a veteran of the Armed Forces of the United States under the Survivor Benefit Plan program established by the U.S. Department of Defense
- military benefits paid to the surviving spouse of a veteran of the Armed Forces of the United States.
