I'm sorry to hear of your loss. If the benefits are included in box 5 on your SSA-1099 form they will be included with your social security income that will be used to determine how much is taxable on your return. I don't know why the benefits would appear on the SSA form though, especially if he wasn't receiving benefits. If you are now receiving his benefits because they are more than yours, that may be why the refund appears on your SSA-1099 form. You may want to call the social security administration and ask about it.
