I was hired to work for a new company. He took income tax out of my checks. Now he sent me a 1099-NEC instead of a W 2. What should I do? I am no longer working there.

Do I have to formally request that he correct the problem and will an email suffice as notification? Or can I file form 4852 without contacting him? I do not feel he will correct this problem after I notify him.
