Q. My child e-filed her own tax and checked a box that somebody may claim her as dependent. I am planning to e-file my own tax claiming her as dependent. Can I e-file my tax?

A. Yes.

 

Q. I was told that IRS will reject mine and I need t mail file my tax. Is it true? 

A. There's a grain of truth there. If she did not check that box, you would be prevented from e-filing.  

 

Q. Is there any income limit of a child for me to claim a child as dependent? 

A. Simple answer: No.

There are two types of dependents, "Qualifying Children"(QC) and Other ("Qualifying Relative" in IRS parlance even though they don't have to actually be related). There is no income limit for a QC but there is an age limit, student status, a relationship test and residence test.

A child of a taxpayer can still be a “Qualifying Child” (QC) dependent, regardless of his/her income, if:

  1. He is under age 19, or under 24 if a full time student for at least 5 months of the year, or is totally & permanently disabled
  2. He did not provide more than 1/2 his own support. Scholarships are excluded from the support calculation
  3. He lived with the parent (including temporary absences such as away at school) for more than half the year

If your child does not meet the rules for being a QC, then there is an income limit of $5050 to be a Qualifying Relative.

Q. My child e-filed and entered the info of 1098T. I paid most of the tuition. Can I enter 1098T info when I file my tax?

A. Yes. Since the student is your dependent, only you can claim the tuition credit and you should enter the 1098-T to do so.  Just because your student entered the 1098-T, in TurboTax(TT), does not mean she actually "filed" it. TT should have told her that she did not qualify for the credit.  If her scholarships exceeded her tuition, TT would treat the excess as taxable income.  If this is the case, replay back for instructions. There is a loop hole available to allow you to still claim the tuition credit.
