No, do not include it as income on your Tax Year 2022 Federal tax return. 

 

It's a very interesting question. 

It is a State Credit, so even if you receive a refund, that refund won't be sent to you until 2023, so it can't be income for 2022.

 

Will the refund from the State be considered as Taxable Income for Tax Year 2023? 

Perhaps. 

I believe that if the credit increases your state refund, you MAY need claim that as income next year, but that might be contingent on whether you use the Standard Deduction for your Tax Year 2022 Federal Return (in which case you won't claim it) or if you Itemize Deductions on your Tax Year 2022 Federal Return, (in which case you MIGHT claim some or all). 

 

You DO NOT need to claim any income because of this credit for the tax return you are working on now (Tax Year 2022) and hopefully next year there will be more information published to clarify the refund.
