The Roth IRA is not a tax deductible contribution. The rule on whether or not you can contribute to either a Traditional IRA or a Roth IRA does not have to do with a tax liability but whether or not there is earned income. What is his AGI? What are the deductions? If he shows earned income then he can contribute.
