IRS Fine Assessment
The IRS staggers fines based on how late your W-2 forms are filed. A penalty of $50 per form is assessed for W-2s filed within 30 days of the due date ( January 31, 2020), up to a maximum of $187,500 for a small business. For forms filed before August 1 but later than 30 days, the penalty climbs to $100 per form and a maximum fine of $536,000. The maximum fine is $260 per form up to $1,072,500 per year for forms filed after August 1.
